While we are all excited about the SC starting the real fight (because that's what these rulings do) on carry and abortion, they slipped this one in that I am not so sure about
multiple courts ruled that no violation of Miranda occurred. Miranda only applies when someone is in custody and the nurses aid clearly was not in custody when he gave his statement, as determined by two different courts that allowed the statement to be admitted into evidence. Had the statement been found in violation of Miranda, it would not have been allowed to be presented or even mentioned. This was a super easy call. The fact that 3 of the judges dissented is the only alarming part.

Thanks. I was not familiar with the case and have not had time to pursue it today.
